什么是Title IX?

Title IX of the Education Amendments of 1972 (“Title IX”) prohibits discrimination on the basis of sex in any federally funded education program or activity. Sex discrimination includes sex-based harassment, discrimination on the basis of sex and retaliation related to complaints of sex discrimination. Sex-based harassment is unwelcome conduct which includes both sexual harassment, including but not limited to sexual assault, other forms of sexual violence and other sexual misconduct and 性别-based harassment. This applies to academic, educational, athletic and residential programs.

Immaculata University is committed to providing and maintaining a safe and healthy educational and work environment in which no member of the University community is, on the basis of sex, sexual orientation or 性别 identity, excluded from participation in, denied the benefits of, or subjected to discrimination in any University program or activity. Gender-based and sexual harassment, 包括性ual violence, are forms of sex discrimination in that they deny or limit an individual’s ability to participate in or benefit from University programs or activities.

的 University will comply with Title IX of the Education Amendments of 1972 (Title IX), the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act), as amended by the Violence Against Women Reauthorization Act of 2013 (VAWA), and Title VII of the Civil Rights Act of 1964, which prohibits discrimination on the basis of sex in employment; and other applicable law.

It is the policy of the University to provide educational, preventative and training programs regarding sexual or 性别-based harassment; to encour年龄 reporting of incidents; to prevent incidents of sexual and 性别-based harassment from denying or limiting an individual’s ability to participate in or benefit from the University’s programs; to make available timely services for those who have been affected by discrimination; and to provide prompt and equitable methods of investigation and resolution to stop discrimination, remedy any harm and prevent its recurrence.

Clery行动/ VAWA

的 Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act) requires higher education institutions to publicly report crimes that occur on their campuses. In compliance with the Clery Act, Immaculata University publishes an annual security report containing important safety information and crime statistics from the previous three years within set geographic boundaries. This data includes crimes that have occurred on campus, in certain non-campus buildings or properties that are owned or controlled by Immaculata University, and on public property within or immediately adjacent to and accessible from the campus.

的 U.S. Department of Education Handbook for Campus Crime Reporting assists universities and colleges in meeting the Clery Act requirements. 根据法律, a crime is reported when a victim, 见证, other third party or even the offender brings it to the attention of a Campus Security Authority (CSA) or local law enforcement officer. A CSA is an individual within the Immaculata community who has significant responsibility for student and campus activities. CSAs should report crimes immediately by calling 610-854-2451 or extension 5555.

Immaculata University is required to report the crimes regardless of whether the victim chooses to file the incident with law enforcement or to press charges. If Campus Security Authorities have any doubt as to whether an incident is reportable, they must err on the side of reporting and do so as soon as possible. Campus Security Authorities should not investigate the crime or attempt to determine whether a crime took place. 的 Department of Safety and Protection will contact them if any additional information is needed.

的 University is required to dis关闭 statistics for offenses that occur (1) on campus (2) in or on non-campus buildings or property owned or controlled by the University, and (3) public property within or immediately adjacent to our campus (e.g., streets, sidewalks and parking areas).

的 criminal offenses that should be reported are:

• Murder, negligent and non-negligent manslaughter
• Sex offenses including rape, fondling, incest and statutory rape

• Aggravated assault

• Motor vehicle theft
• 纵火
• All liquor, drug or weapons violations resulting in arrest or referral for disciplinary action

• Domestic violence

Immaculata University is also required to report statistics for hate crimes. For purposes of reporting, please report any crime as a hate crime where there is any indication that the victim was selected because of the victim’s actual or perceived 比赛, 国家的起源, 种族, 宗教, 残疾, 性别, 性别 identity or sexual orientation. CSA’s should tell a person who comes to them to report a crime that they are required to report the incident to 校园安全 and Protection. 的y should inform the individual that if he or she requests confidentiality, the report will not include identifying information, but that if it is an incident of sexual misconduct, the Title IX Coordinator will be informed of the victim’s identity and be notified that the victim wishes to maintain confidentiality.

Title IX Office Training

第106节.45(b) of the 2020 Title IX regulations requires the sharing of “all materials used to train Title IX Coordinators, 调查人员, decision-makers and any person who facilitates an informal resolution process. A recipient must make these training materials publicly available on its website, or if the recipient does not maintain a website the recipient must make these materials available upon request for inspection by members of the public.”
